1. Acceptance of these Terms
These Terms of Use (the “Terms”) form a binding agreement between you (“you,” “your,” “user,” or “member”) and [COMPANY LEGAL NAME], a [STATE] [entity type] (“MetCheck,” “Metabolic Checkup,” “we,” “us,” or “our”), governing your access to and use of the MetCheck website, mobile experiences, applications, AI coaching tools, screeners, assessments, content, and related services (collectively, the “Services”).
By creating an account, accessing, or using the Services, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Services.
Important: The Services are not medical advice and are not a substitute for diagnosis, treatment, or care from a licensed healthcare professional. See Section 6 (Health Disclaimer) and Section 14 (Disclaimer of Warranties).
2. Eligibility and account registration
You must be at least 18 years old (or the age of majority in your jurisdiction) and able to form a legally binding contract to use the Services. The Services are not directed to children under 13, and we do not knowingly collect personal information from them. See our Privacy Policy for details.
When you create an account, you agree to provide accurate, current, and complete information and to keep it updated. You are responsible for safeguarding your password and for all activity that occurs under your account. Notify us immediately at [CONTACT EMAIL] if you suspect unauthorized use.
We may refuse, suspend, or terminate accounts at our discretion, including for violations of these Terms, suspected fraud, abuse, or risk to other users.
3. Description of the Services
The Services include, among others:
- QuickScreen, Wellbeing Checkup, Behavioral Health Checkup, Resilience Checkup, and other screeners and assessments. Educational, self-administered tools that generate informational scores and bands based on your inputs and validated screening instruments.
- AI Coaching. Conversational coaching from our AI coach personas (e.g., Coach Nia, Coach Kai, Coach Ren) on metabolic health, behavior change, sleep, stress, nutrition, and movement. AI coaching is educational and does not replace a clinician.
- Filing Cabinet. A personal area where your saved screener results and assessments are organized for your reference.
- Tools, content, and learning resources intended to support educational understanding of metabolic and wellness topics.
We may add, modify, or remove features at any time. Some features are available only to paid subscribers (Silver, Gold, or Platinum) or to specific geographies.
4. Subscriptions, billing, and refunds
Free accounts are available at no cost. Paid plans (Silver, Gold, Platinum) and add-ons (such as additional AI coaching message packs) are billed in advance on the cadence you select (monthly, quarterly, semi-annual, or annual) at the price displayed at checkout.
Payments are processed by our third-party payment processor (currently Stripe). By providing payment information, you authorize us and our payment processor to charge the applicable fees, taxes, and other charges to your selected payment method.
Auto-renewal. Subscriptions automatically renew at the end of each billing period at the then-current rate unless you cancel before the renewal date. You can cancel at any time from your account settings; cancellation takes effect at the end of the current paid period and you retain access until then.
Refunds. Except where required by law, fees are non-refundable. Extra message packs purchased for AI coaching expire 30 days after purchase and do not roll over.
Price changes. We may change prices for future billing periods. If we do, we will give you reasonable advance notice and an opportunity to cancel.
5. Optional blood testing and third-party labs
Some Services reference an optional blood panel offered through a third-party lab partner (e.g., Ulta Lab Tests / Quest Diagnostics). MetCheck is not a clinical laboratory and does not perform, supervise, or interpret laboratory tests. Any lab services are governed by the terms, fees, and privacy practices of the third-party provider you choose.
You are solely responsible for following all fasting and preparation instructions, discussing results with a qualified clinician, and following up on any abnormal findings.
6. Health disclaimer — not medical advice
MetCheck provides educational wellness information only. The Services do not constitute medical advice, diagnosis, or treatment, and they are not a substitute for the professional judgment of a licensed healthcare provider.
Screener scores, AI coaching messages, and other outputs are informational signals intended to support discussions with qualified professionals. Never disregard, avoid, or delay seeking professional medical advice because of something you read or receive through the Services. Do not start, stop, or change any medication based on the Services.
If you may be in crisis, may harm yourself or others, or face a medical emergency, call your local emergency number immediately. In the United States, call or text 988 for the Suicide & Crisis Lifeline, or 911 for emergencies.
7. AI coaching — special terms
AI coaching responses are generated by large language models. They may be inaccurate, incomplete, or out of date, and they will not reflect the judgment of a clinician who knows your full medical history. You should independently verify any information that could affect your health, finances, or safety.
Conversations may be retained to provide the service, support your account, train the coaching prompt configuration, monitor safety, and improve quality. We do not sell the contents of your coaching conversations. See our Privacy Policy for full details.
Usage limits apply (currently 100 messages/month for Gold and 200 messages/month for Platinum, plus optional purchasable extras). We may rate-limit or suspend access to prevent abuse, fraud, or excessive load.
8. Automated translation of clinical content
The MetCheck Services are authored in English. When you select a non-English language, the questions, answer options, severity bands, recommendations, and accompanying copy inside our screeners (PHQ-9, GAD-7, AUDIT, PCL-5, ACE, ASRS, MDQ, NODS, SCOFF, FTND, GSAQ, NM-ASSIST, OAS, PADIS, PQB, CBI, RAS, FSS, SDOH, sleep, moral injury, WSS, resilience, etc.), the Full Assessment, the Assessment Report, the QuickScreen, and the QuickScreen Results may be displayed using automated machine translation.
These automated translations have not been clinically validated in the target language and have not been reviewed by the original instrument authors or by a licensed clinician fluent in that language. Translated wording, severity labels, and interpretive narrative may not be directly comparable to the published clinical norms, which were established for the validated English version of each instrument.
Scoring math, severity-band thresholds, and the values stored in your account remain based on the canonical English instrument so historical results stay internally consistent regardless of which language you view them in. The English version remains the authoritative source for any clinical or legal interpretation of your results.
By using the Services in a non-English language you acknowledge and accept this limitation. If you are uncertain about a translated phrase or score interpretation, switch the language back to English to view the validated source text and discuss your results with a qualified bilingual professional.
9. Communications and email preferences
By creating an account, you agree to receive transactional emails necessary to operate the Services, including account confirmations, password resets, security alerts, billing receipts, subscription notices, screener and assessment results, and other service-related notifications. You cannot opt out of these messages while you maintain an active account, as they are required to deliver the Services.
You may also receive periodic promotional emails, newsletters, product updates, educational content, and marketing communications from MetCheck. By default, new accounts are enrolled in all optional email categories. You may adjust these at any time. You can opt out of these non-essential messages by (a) toggling the relevant preferences in Account → Email preferences, or (b) clicking the unsubscribe link in the footer of any such email. Opting out of marketing messages will not affect delivery of transactional emails.

10. SMS / text messaging program
Program description. If you opt in by providing your mobile phone number and checking the SMS consent box during registration (or later in your account settings), MetCheck (Metabolic Checkup) will send text messages for two-factor authentication (2FA) codes, account security alerts, and critical account notifications. We do not send promotional or marketing text messages.
Message frequency. Message frequency varies and is driven by your account activity (sign-ins, security events, account changes).
Cost. Message and data rates may apply. MetCheck does not charge for the messages, but your wireless carrier’s standard rates apply.
Opt-out. You can cancel the SMS service at any time by texting STOP to the number from which you received messages. After you send STOP, we will send you a confirmation message and will not send any additional messages, except that 2FA codes you actively request at sign-in may still be delivered if required to access your account.
Help. Reply HELP for assistance, or contact us at /contact.
Carriers. Supported carriers include AT&T, Verizon Wireless, T-Mobile, Sprint, and most other U.S. wireless carriers. Carriers are not liable for delayed or undelivered messages.
Privacy. Your mobile phone number and SMS opt-in consent will not be shared with third parties or affiliates for marketing purposes. See our Privacy Policy for details.
11. User content and license
You retain ownership of the information you submit to the Services (including screener answers, assessment data, biometric inputs you choose to enter, coaching messages, and feedback) (“User Content”). You grant MetCheck a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, process, adapt, and use your User Content as needed to operate, secure, support, and improve the Services and to comply with law.
You represent that you have all rights necessary to submit your User Content and that it does not violate any law or third-party right. You will not submit content that is unlawful, infringing, harassing, deceptive, or that contains malware.
12. Acceptable use
You agree that you will not, and will not attempt to:
- Use the Services for any unlawful, fraudulent, or harmful purpose;
- Provide false, misleading, or another person’s information without authorization (including impersonating another user or healthcare professional);
- Use the Services to seek or provide individualized clinical care, diagnosis, or prescription decisions for yourself or others;
- Probe, scan, or test the vulnerability of the Services, or breach any security or authentication measure;
- Reverse engineer, decompile, scrape, or copy any portion of the Services except as permitted by applicable law;
- Use the Services or AI coaching outputs to train competing AI models or to build a competing product;
- Interfere with or disrupt the Services, servers, or networks, or attempt to gain unauthorized access to any account or system;
- Submit content that infringes intellectual property, privacy, publicity, or other rights, or that is defamatory, harassing, hateful, or otherwise objectionable.
13. Intellectual property
The Services and all content provided by MetCheck (including software, designs, text, graphics, logos, scoring algorithms, coaching prompts, and the “Metabolic Checkup” and “MetCheck” marks) are owned by MetCheck or its licensors and are protected by intellectual property laws. Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Services for your personal, non-commercial use.
Validated screening instruments referenced in the Services (for example, PHQ-9, GAD-7, AUDIT, CBI) are the property of their respective copyright holders and are used in accordance with their terms.
14. Third-party services and links
The Services may integrate with or link to third parties (such as Stripe for payments, Google for sign-in, Ulta Lab Tests / Quest Diagnostics for optional bloodwork, and AI model providers used for coaching). MetCheck is not responsible for third-party content, products, or practices. Your use of those services is governed by their terms and privacy policies.
15. Suspension and termination
You may terminate your account at any time from account settings. We may suspend or terminate your account or access to the Services at any time, with or without notice, for any reason including suspected violation of these Terms, risk to other users, or failure to pay fees.
Upon termination, your right to use the Services ends. Sections that by their nature should survive (including ownership, disclaimers, indemnity, limitation of liability, dispute resolution, and miscellaneous) will survive.
16. Modifications to the Services and Terms
We may update the Services and these Terms from time to time. If we make material changes to these Terms, we will provide reasonable notice (for example, by email or in-product notice) before they take effect. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
17. Disclaimer of warranties
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. METCHECK AND ITS LICENSORS DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, ACCURATE, OR SECURE, OR THAT ANY INFORMATION OR AI OUTPUT IS RELIABLE, COMPLETE, OR APPROPRIATE FOR YOUR CIRCUMSTANCES. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.
18. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, METCHECK AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR HEALTH OUTCOMES, ARISING OUT OF OR IN CONNECTION WITH THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
METCHECK’S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO METCHECK FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above limitations may not apply to you.
19. Indemnification
You agree to defend, indemnify, and hold harmless MetCheck and its affiliates, officers, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from or related to: (a) your use of the Services; (b) your violation of these Terms or any law; (c) your User Content; or (d) your decisions or actions taken in reliance on the Services.
20. Governing law and dispute resolution
These Terms are governed by the laws of the State of [STATE], United States, without regard to its conflict-of-laws principles. Subject to the arbitration provision below, you and MetCheck consent to the exclusive jurisdiction of the state and federal courts located in [COUNTY], [STATE].
Binding arbitration. Any dispute, claim, or controversy arising out of or relating to the Services or these Terms shall be resolved by final, binding, individual arbitration administered by JAMS under its Streamlined Arbitration Rules, conducted in [CITY, STATE] or by remote means. Either party may bring claims in small-claims court if eligible.
Class-action waiver. You and MetCheck agree to bring claims only in your individual capacity, and not as a plaintiff or class member in any class, collective, or representative action.
30-day opt-out. You may opt out of arbitration and the class-action waiver by sending written notice to [CONTACT EMAIL] within 30 days of first accepting these Terms.
21. Miscellaneous
These Terms, together with the Privacy Policy and any plan-specific terms presented at checkout, are the entire agreement between you and MetCheck regarding the Services. If any provision is held unenforceable, the remaining provisions will remain in effect. Our failure to enforce any right is not a waiver of that right. You may not assign these Terms without our prior written consent; we may assign them in connection with a merger, acquisition, or sale of assets.
